Grounds for Termination of Employment

Each state has its own set of laws specific to termination of employment. However, you should be aware of the legal and illegal reasons for employee termination that apply to most workplaces in the United States.

Considerations

Many employees within the United States work on an “at-will” basis, which means that your employer can fire you for any legal reason.

Legal Grounds for Termination

The most common legal grounds for termination include violating company rules or procedures, being absent or late for work on a regular basis, using drugs or alcohol at work or bad performance. Your employer can also fire you because the company has eliminated your position or can no longer pay you.

Illegal Grounds for Termination

An employer cannot fire you because of discrimination against human factors such as race, gender or nationality. Your employer cannot fire you in retaliation for starting a claim of discrimination or “blowing the whistle” on unethical or illegal activity. An employer also cannot terminate an employee for having a legal resident status or for refusing to take a lie detector exam.
