Employment Laws on Blacklisting

Blacklisting is a discriminatory action taken by an employer which is meant to terminate a person's employment or to stop them from getting future employment. Blacklisting can involve slandering a person, recommending that another business not employ them, or actively creating a list of persons and their information which will be disseminated to other businesses. Throughout the world there are a variety of laws meant to prevent blacklisting, and the practice is slowly but surely dying out in many countries.

North Carolina

One of the states in America that has a fairly comprehensive blacklisting law is North Carolina. According to this state's law: employers may not attempt to prevent, either verbally or in writing, discharged employees from obtaining new employment. This law doesn't prevent employers from giving honest and truthful statements about previous employees' work, though. So if a potential employer asks questions of a previous employer, then that previous employer can tell the potential employer any truthful facts that pertain to the questions asked.

Great Britain

The problem of blacklisting is also present overseas. In Great Britain, there have been problems in the past involving the blacklisting of trade union employees. Employers were subscribing to a database that was disseminating information of blacklisted employees and making hiring and firing choices based on those lists. As of 2009, the British Parliament is going into session to pass comprehensive legislation regarding the blacklisting of labor union employees, which will also apply to other, non-union employees.

2000 Blacklisting Law

In the year 2000, the federal government passed blacklisting regulations that have since been repealed. The law was known as the contractor responsibility law, and it was meant to give the federal government the power to blacklist contractors based on alleged "unsatisfactory" performance in the past. The law did not reflect whether or not the contractors actually had the capacity to perform the work asked of them and was used as a tool to manipulate government contractors. These regulations were later suspended under President George Bush in 2001.
